So the apraisel company is complaining about this:

The wall ends at my garage. The garage is legally one foot off the property line but the neighbor has incroached into our side of the property. Their yard goes all the way to the garage wall. SO WHAT! You can see my yard is exactly the same way on the oposite side, we are encroaching into our neighbors property line aswell. All the houses do along this track. You can see there is no wall the plants are up against. It the neighbors garage wall.

So this is the house you are buying, correct?

If this is the case for each house, surely the city has records of permits, etc.

This just sounds like the lender is being skiddish. Look for a different lender in that case.

This e mail came yesterday from our agent:

Sheila just sent me this text...

Just got the easement condition removed- thank god- they are clearing my other two conditions right now-
then I will start begging for loan docs- keep you up to date as soon as I hear.


then this:

Hi,
Just talked to Sheila, and Debbie. Still no word on
the docs. Debbie is going to call escrow and let them
know we are waiting. She's instructing them to call
you as soon as they get them in. With any luck, if
they come in soon, we can still knock this out before
the weekend.

I'm very happy for you, the past few updates were reminding me of my move process a month or so ago. I had to resist commenting and being negative, but it happens to everyone. I was on the other end of the deal (selling) and it was enough stress for me I had to stay away from getting all worked up again.


but now that it's all over you will be happy, I know I sure am, lol

Thanks guys. Well signing had a few hickups right off the bat, but they were corrected and all went well. Unfortunately we will not get keys till next Tuesday, Fund on Monday and close on Tuesday. If it had not been for the damn apraisers office holding this all up with their crap we would have closed this week and had keys by Friday. Ohwell, we are just happy it moved past the paperwork signing and now I just have to wire funds which I will tomorrow and then close next week. So it is killing our moving this weekend but we still have plenty of packing to do and I will now work Saturday OT. Can always use the extra money of course. But I will be off after that till the 12th of next month. Still can be out by the end of the 4th of July weekend.

When it's all said and done, you were VERY, VERY fortunate to find AND close on a new home that quickly. The stars must have been aligned correctly for you and your family.

Bringing up the encroachment issue, when I was looking at your pics of the house I noticed your planter up tight to the neighbors garage wall and thought that you must have some strange 'zero' lot lines in your neighborhood, but then you stated the 1 foot setback which got me thinking....hummmmm

Like they say, "Alls well that ends well". Good luck on the move.....and remember

Ya and move the roll bender first that way its there if ya need to tinker on it.

And congrats on closing also. I had a hell of a time closing on my house. Finally got an offer accepted and come to find the house would not appraise for the loan value because the 2 upstairs bedrooms didnt have heat and air ducting to them so they "technically" were'nt "living quarters" but instead "storage". And "storage" didnt count towards square footage so the house was 1/3 - 1/2 the sq ft it really was. I ended up having to split the cost of the ductwork with my realtor, HE had it installed and i payed him back. All so we could CLOSE the deal. Everyday there for a while was bad news on the phone. I was just glad my realtor came through on it. I was happy in the end. Thats why i said in the beginning you were luck to have looked, found, closed on a house so quick.

Well they finally funded the loan. Should close tomorrow and get keys sometime tomorrow. Can't hardly stand the waiting but we're getting there.

I had some stories like yours when we were selling our other home. We had a no-contingent buyer ready to buy and he had an independent inspector come and go through EVERYTHING. We had our basement completely built and it was spectacular to say the least. $50k in work with beautiful ceramic floors and full on bar plasma tv's, etc.
The inspector says, there is no sump. We tell them that there is a sump bucket filled with rock and a cap because the ceramic floor covers it up. They tell us they want to "see" the bucket and make sure there is no water, etc. I explain that we can definately do that but it will require the floor being busted up and removing several cabinets. They said, they wanted us to do this. $1000 later we have the entire floor busted up and cabinets out. They come by and give us the "okay" to put it back together. I TELL them, make sure you are happy with everything before we put it back together. I also OFFER to install a sump pump, etc. NOW because once it goes back together you cannot get to it again. They say, no need, just to put it back together and close it up.
1 week later they are going through their final walk through and we left a "window" to view the bottom of the pit inside the cabinet. They say, we see water and now want the pumpo installed!!!!!!!!!!!!! Mother ****er!!! We had to pull everything BACK out and put the sump pump and re-install everything. So, what should have been a $1k bill turned into over $3k. All out of OUR pocket!
I feel all your guy's pain. Just hang in there and it will work out!

OMG!!! THAT IS INSANE!! I would have looked into some kind of complaint or lawsuit over that BS. That is just not right. I'm sorry you had to go thru such a thing. I can just imagine the kind of anger you must have felt. How long ago was this? Could you have had any legal leg to stand on with a lawsuit? Or were you just SOL and you have to do as they say? Sure seems like harassment or SOMETHING illigal.

I will let you guys know as soon as we get keys. Thanks for the support guys

It was recorded today. Won't actually confirm till later today, but the listing agent said we can go pick up the keys and start moving TODAY! Taking our first load over in an hour or so. My truck was loaded yesterday! YEAH!! WE ARE IN!! Pics of our first day asap!

As you may or may not know, whenever a new homeowner moves in, on the first Sunday of the move, FIREWORKS are set off in celebration of the new neighbor, so keep your eyes peeled for the festivities!!!

Well we are moved in. Not everything is in it's place, infact we still have alot left to put away. But we are all in and it is GREAT!!! to have our own house. The move......the move was BRUTAL to say the least. I have to give mad props to my friends who offered to help and those who I asked to help who gladly said no problem. It was BY FAR the hardest move of any bodies house I have even moved. The house was basically easy, but the garage was hell. Moving my two NON running trucks, one with axles and no brakes OR steering was dangerous to get down a good slope, turned, and onto a car trailer. My crew cab with NO axles under it was moved and roled onto the trailer using good quality heavy duty carpet dollies. At one point we had it jacked up and it colapsed off the jack onto the trailer. Thank god nobody got hurt. We got it back up and on to the trailer.

I still have to get my suburban running and moved. That wont be an issue. The last thing I moved was my 80 gal upright compressor. If you have never moved one or have no idea how heavy they are, I can tell you their heavy as hell cause their top heavy. I was pulling the hand truck, aka, dolly up ramps as my neighbor was pushing, and the ramps started flexing and my neighbor was pushing faster then I could step. I lost my ballance and footing and it fell on top of me. I took the brunt of it in the shoulder,

But it scraped my back and bruised my shoulder and jambed it too and my bicep and forarm are bruised good aswell. Gave me a monkey bump at the corner of my right eye too. Didn't even know I was hit in the head till driving home I felt my temple and eye and it was bruised pretty good. Had a good raised knot at that spot. My buddy who did the majority of the helping has bruises all over, I said I do too! I blasted my back and bought a back brace on the third day. Of course I should have bought one the first damn day. Took a full week of moving. Including two full days with a liftgate truck. Which was a life savor. I had five friends helping move over several different days which I could not have done it without them. Just got back online today. It's good to be back. Garage is not organized at all but I will get there. I'm scatter brained, sorry this sounds cluster F.

lol No it actually sounds like a pretty typical move story!

Moving is always a bear if you own any amount of anything. I get to move soon myself (again) so I am glad I have gotton rid of about half my stuff since the last time I moved but it still will not be pretty.

Glad to hear you got moved. I know how it is when you have tons (literily) of stuff to move. I dread the day I have to move again.

Once everything is moved, and you recouperate, you can work at organizing at your own pace. Of course invariably there will be something that you need to do, so you need to set something up quick to get the job done.

Have you given your former landlord the official yet?
